Can The Public Access The California Criminal Records Of Sex Offenders?
In terms of the constitution and the Public Records Act, the public has a right to access California criminal records. These include records that are maintained by state and local government agencies, as well as the Department of Justice. The records are available through different data bases in the state.
Many of these data bases are kept by law enforcement agencies. They contain information on public criminal records, Federal criminal records, prison records, and inmate records. With the number of sex offences increasing, especially those involving children, the California Department of Justice has a website that gives a list of all registered sex offenders in the state.
This is a result of a law passed in the USA instructing law enforcement authorities to allow the public access to information regarding any registered sex offender. This law came into being when a 7 year-old girl, Megan Kanka, was murdered by a sex offender in 1994. This law is informally known as Megan's Law.
It states that the public has the right to every offender's name, address, date of incarceration, the nature of the crime, as well as a photograph of the offender. This information can be published in newspapers, displayed on websites, distributed as pamphlets, or any other means.
The California Department of Justice's website provides such information on 63,000 people who have registered as sex offenders. More than 33,000 home addresses of these offenders are also displayed. An additional 30,500 sex offenders are displayed on the site with their county, city and ZIP code. A further 22,000 are not included on the site, but their whereabouts and personal details are known to law enforcement officers.
This site is therefore extremely useful for members of the public who want to check on a potential employee will work in an environment that exposes them to vulnerable people like women and children. The knowledge that the majority of sex offences are perpetrated by acquaintances or friends of the victim is obviously very alarming to the public.
When you go onto the Department of Justice's website, you will first have to read and acknowledge a disclaimer. You may then search by the person's name and obtain a detailed profile. A map on the site enables you to even search your neighborhood, or any other place in California, to find out where the person lives. As mentioned already, the home addresses of certain offenders are not available to the public.
There is one extremely important factor about obtaining California criminal records for sex offenders. This applies to the sharing of any information received on the website. The law states that information obtained in this manner may only be used to protect someone who could be at risk of becoming a victim by the offender. It is illegal to use the information to commit a felony or misdemeanor. In addition, you are not allowed to use the information for the purposes of background checks for health insurance, credit, loans, or education.
